CONTRACTUAL CONDITIONS

These Contractual Conditions govern the purchase and supply of digital products available on the UrbexLocation.it website, hereinafter also referred to as the "Site".
Before making a purchase, the user is invited to read these conditions carefully.
By placing an order on the Site, the buyer declares that he has read and accepted these Contractual Conditions.
In the remainder of these conditions, the person purchasing a product is referred to as the "Purchaser".

2. OBJECT OF THE SERVICE
UrbexLocation.it offers the sale of digital products containing geographic information relating to urbex locations, mainly in the form of .KML files.
The files may contain, depending on the product purchased:
geographic coordinates;
indicative position of the location;
any information associated with the location;
any additional digital information expressly indicated in the product description.
The purchased product consists exclusively of the digital content indicated in the relevant product sheet.
Purchasing a KML file and the coordinates it contains does not imply the purchase of any rights to the location indicated.
3. WHAT IS SOLD
UrbexLocation.it sells geographic information and digital coordinates.
In particular, the product allows the Buyer to receive a digital file containing the coordinates of the location being purchased.
UrbexLocation.it does not sell:
the property indicated by the coordinates;
the right of ownership of the property;
the right of access to the property;
an authorization to access the location;
a permit to enter the building;
an authorization to pass through gates, fences or other delimitation systems;
an escort service;
a security service;
a security service;
an on-site guide service.
The purchase of the coordinates constitutes exclusively the purchase of the related digital content.
4. ACCESS TO THE LOCATIONS AND BUYER'S RESPONSIBILITIES
The purchaser is solely responsible for his or her decisions and actions after purchasing the product.
The sale of coordinates does not in any way constitute authorization, invitation, or encouragement to access private property or engage in activities unlawfully permitted.
Before going to a location, the Buyer is required to independently check:
the ability to legally access the area;
the possible need for authorizations;
ownership of the property;
any access restrictions;
the safety conditions of the place;
the presence of fences, gates, security systems or other obstacles;
any other circumstance relevant to the legitimacy and safety of your business.
The Buyer is responsible for complying with all laws, regulations and the rights of the owners or entitled parties.
It is expressly forbidden to interpret the purchase of coordinates as authorization to:
entering private property without permission;
force doors or windows;
climb over fences;
damage structures or security systems;
remove obstacles;
circumvent security systems;
commit any other unlawful conduct.
UrbexLocation.it does not provide access permissions and cannot grant permissions relating to third-party properties.
5. LOCATION LIABILITY
Location conditions can change over time.
A location may, following the publication or sale of the coordinates:
to be demolished;
to be refurbished;
be busy;
be made safe;
be fenced;
become inaccessible;
change owner;
be subject to work;
no longer be traceable to the description present at the time of insertion.
UrbexLocation.it does not guarantee that a location will remain unchanged over time.
The coordinates are provided based on the information available at the time of publication and sale of the product.
The Buyer therefore accepts that the actual situation of the location may differ from that present at the time of purchase.
6. DEAD SPOT
A "Dead Spot" means a location whose coordinates refer to a place that, at the time of the Buyer's report, no longer exists in the form in which the product is located, for example because the building or structure has been demolished.
The simple inability to physically access the location does not automatically constitute a Dead Spot.
For example, the following do not necessarily constitute Dead Spots:
a closed gate;
a fence;
a ban on entry;
a change in access methods;
the presence of a new owner;
the Buyer's inability to obtain authorization;
conditions that legally or physically impede access.
7. DEAD SPOT ASSISTANCE
UrbexLocation.it provides assistance only if the Buyer reports a possible Dead Spot relating to the purchased location.
After verifying the report, UrbexLocation.it may, at its sole discretion:
provide a new replacement location of equivalent value; or
proceed with the refund of the purchase if the replacement is not possible or is not deemed appropriate.
Dead Spot verification is performed based on the information available at the time of the request.
Any refund or replacement provided for in this article does not constitute a general right of withdrawal or return of the digital product.
8. DELIVERY OF THE DIGITAL PRODUCT
The products are supplied exclusively in digital format.
Following successful completion and confirmation of payment, the product can be made available through:
a download link sent to the email address provided by the Buyer;
the Buyer's personal area on the Site.
The delivery of the digital product takes place, where technically possible, immediately or in any case without undue delay after confirmation of payment.
The Buyer is responsible for providing a correct email address and maintaining the necessary data to access their account and purchased content.
9. FILE FORMAT
Products containing coordinates may be supplied, among other formats indicated in the relevant product sheet, in .KML format.
The Buyer is responsible for having a device and software compatible with the file format purchased.
Any incompatibility of the device or software used by the Buyer does not in itself constitute a defect in the digital product.
10. PERSONAL USE OF THE PRODUCT
The purchased digital file is intended for the Buyer's personal use.
It is prohibited, without prior written authorization from the Owner:
resell the file;
give or transfer the file to a third party;
exchange the file with other users;
publish the file online;
upload the file to sites, forums, groups or platforms;
distribute the file via social networks or messaging services;
share the download link;
make the purchased coordinates publicly available;
use the content to create and market a competing product;
systematically extract, copy or redistribute the coordinates contained in the product.
The Buyer may use the file for his/her own personal purposes, within the limits permitted by law and these conditions.
11. PROHIBITION ON SHARING YOUR ACCOUNT AND LINKS
The login credentials for your personal area are personal and must not be shared with third parties.
Similarly, the links used to download purchased products must not be shared, published, or transferred to other parties.
The Buyer is responsible for the safekeeping of his/her credentials and access links.
In case of anomalous use, abuse or unauthorized sharing, UrbexLocation.it may adopt the necessary measures to protect the service and its contents.
12. INTELLECTUAL PROPERTY
The contents present on the Site and in the digital products, including, where applicable:
texts;
descriptions;
photographs;
graphics;
maps;
file;
content structures;
information collections;
distinctive elements of the Site;
are protected by applicable intellectual property legislation, to the extent that the conditions exist.
The purchase of a digital product does not imply the transfer to the Buyer of intellectual property rights relating to the content.
The Buyer receives only the right to use the product for his/her own personal purposes, within the limits of these Contractual Conditions.
13. PRICES
Product prices are those indicated on the Site at the time of purchase.
UrbexLocation.it may change product prices at any time.
The price applicable to the Buyer is the one displayed at the time of completing the order.
Any promotions, discounts or promotional codes may be subject to specific conditions indicated on the Site.
14. PAYMENTS
Payments are made through the payment systems available on the Site.
Currently, order payments are handled through Wix Payments.
The pay transaction
mento may be subject to the terms, conditions and security procedures of the relevant payment service provider.
UrbexLocation.it does not store complete payment card details, except where handled directly by the relevant provider according to its own methods and policies.
15. CONCLUSION OF THE CONTRACT
The purchase contract is considered concluded when:
the Buyer selects the product;
proceed with the order;
accept these Contractual Conditions;
complete the payment;
the payment is successfully authorized.
Order confirmation and purchase information may be sent to the email address provided by the Buyer.
16. RIGHT OF WITHDRAWAL AND DIGITAL CONTENT
The products sold by UrbexLocation.it are digital content provided through non-material media.
The delivery of the digital product can begin immediately after the purchase is completed.
Before the start of the supply, the Buyer will be informed that:
the digital product will be provided immediately;
the supply will begin before the expiry of the ordinary withdrawal period;
With his express consent to the immediate start of the supply, the Buyer agrees to lose the right of withdrawal provided for digital content, within the limits and under the conditions set forth by applicable legislation.
Therefore, once the supply of the digital content has begun with the express consent of the Buyer and with the relative acceptance of the loss of the right of withdrawal, it will not be possible to request the withdrawal or return of the product due to simple change of mind.
The regulation does not affect the Buyer's mandatory rights under applicable legislation regarding the conformity of digital content and consumer protection.
17. NO RETURNS ON DIGITAL PRODUCTS
Digital products, once supplied to the Buyer in accordance with the methods set out in these conditions, cannot be physically returned.
Therefore, returns or refunds are not foreseen due to:
second thoughts;
lack of interest after purchase;
failure to use the file;
purchase made by mistake by the Buyer;
incompatibility with non-compatible software or devices;
impossibility or choice of the Buyer not to go to the location;
inability to legally or physically access the location;
presence of fences, gates or access restrictions;
modification of the location conditions after purchase.
The assistance and possible refund options expressly provided for in these conditions remain unchanged, including the case of Dead Spot.
Furthermore, any non-waivable rights recognized by applicable legislation remain unaffected.
18. COMPLIANCE OF DIGITAL CONTENT
UrbexLocation.it undertakes to supply the purchased digital content as indicated in the relevant product description.
If the Buyer believes that the file received does not correspond to the purchased product or has a technical problem that prevents its use, he/she must contact the Owner providing a description of the problem.
UrbexLocation.it will evaluate the report and, where applicable, may provide for the correction, replacement, or other solution provided for by applicable law.
19. LIMITATION OF LIABILITY
UrbexLocation.it provides only contact information and information relating to the locations listed in the products.
The Owner does not necessarily control the current condition of the properties listed and cannot guarantee that the conditions of the location will remain unchanged over time.
UrbexLocation.it is not responsible for events or circumstances arising from activities independently undertaken by the Buyer at or near the location.
In particular, UrbexLocation.it is not responsible for:
accesses made by the Buyer;
Buyer's conduct at the location;
any violations of private property;
any violations of laws or regulations;
any damage caused by the Buyer;
accidents arising from access to buildings or areas;
dangerous structural conditions;
presence of dangerous materials, substances or structures;
changes to the location;
closure or demolition of the location, except as provided for by the Dead Spot regulations;
failure to authorize access by the owner or other entitled parties.
The Buyer remains responsible at all times for his/her own actions and for carrying out any necessary checks before travelling to a location.
These limitations apply to the maximum extent permitted by applicable law and do not exclude or limit any liability that cannot be excluded or limited by law.
20. NO ACCESS AUTHORIZATION
The purchase of a coordinate should not be construed as authorization, permission, or consent by UrbexLocation.it to access the indicated property.
The Buyer must independently obtain any authorization that may be necessary.
Any authorizations, permits, owner consents or other requirements necessary to access the location are unrelated to the purchased product and remain the sole responsibility of the Buyer.
UrbexLocation.it does not sell or grant such permissions.
21. SECURITY
Urbex locations can present unpredictable risks.
The Buyer is responsible for his own assessment of the conditions of the location and must act prudently and in accordance with the regulations.
The sale of coordinates does not constitute a certification of the security of the location.
UrbexLocation.it does not guarantee that a location is safe, accessible, stable, or suitable for viewing.
22. CHANGES TO THE CONDITIONS
UrbexLocation.it may modify these Terms and Conditions at any time. Any changes will be posted on the Site.
The conditions applicable to the purchase are those accepted by the Buyer at the time of placing the order, subject to changes imposed by legal provisions also applicable to existing relationships.
23. SUSPENSION OF SERVICE
UrbexLocation.it may temporarily suspend the Site or certain features for technical, maintenance, security, or other operational reasons.
Temporary suspension of the Site does not automatically entail the right to a refund for purchases already correctly supplied.
24. APPLICABLE LAW
These Contractual Conditions are governed by Italian law.
All mandatory provisions of Italian and European consumer protection legislation also apply to consumers.
For anything not expressly provided for in these conditions, the applicable legal provisions apply.
25. DISPUTE RESOLUTION
In the event of a dispute, the parties will first attempt to find an amicable solution.
The consumer's rights under applicable law regarding territorial jurisdiction and judicial protection remain unaffected.

When requesting assistance for a purchase, it is advisable to include the email address used for the order and the purchase details, so that we can quickly verify the order.
27. ACCEPTANCE OF THE CONDITIONS
Before completing the purchase, the Buyer declares that he has read and accepted these Contractual Conditions.
For digital content supplied immediately after purchase, the Buyer must also express his/her consent to the immediate start of the supply and acknowledge the consequent loss of the right of withdrawal, within the terms established by applicable law.
